Consent to receive informational and marketing communications
Updated Effective from Version 1.0
1. General provisions
1.1. This Consent regulates the terms and procedure under which the Operator sends marketing, informational, and promotional messages to the User.
1.2. The Consent is granted in accordance with Article 18 of Federal Law No. 38-FZ of 13 March 2006 «On Advertising» and Article 15 of Federal Law No. 152-FZ of 27 July 2006 «On Personal Data».
1.3. Consent to marketing communications is requested from the User through a separate checkbox, distinct from consent to the Terms of Service, the Privacy Policy, and consent to cross-border personal-data transfers. Granting this Consent is not mandatory for registration or use of the Service.
1.4. The User may grant Consent:
- by selecting the corresponding checkbox on the Service registration form;
- by enabling the corresponding setting in the personal account under «Settings» → «Notifications»;
- in any other way that clearly expresses the User’s intent (for example, subscribing to an email newsletter through a form on the Site).
2. Content of communications (what counts as marketing)
2.1. The following types of messages are sent under this Consent:
- announcements of new Operator features and products;
- information about special offers, discounts, promotions, and referral programs;
- product digests, Service and industry news;
- educational materials (tips and tutorials, how-to guides, case studies);
- invitations to webinars, surveys, and satisfaction studies (NPS);
- offers regarding new pricing plans and expanded functionality;
- communications about partner products and services that align with the User’s interests.
2.2. Delivery channels:
- email;
- push notifications in the browser or mobile application (where available and installed);
- other channels expressly approved by the User (for example, messengers).
3. What is NOT considered a marketing communication
3.1. Service (transactional) messages are not marketing communications and are sent to the User regardless of whether this Consent has been granted. They form part of the performance of the contract between the Operator and the User (Article 6(1)(5) of 152-FZ) and are necessary for delivering the Service.
3.2. Service messages include, in particular:
- notifications about the processing status of User Content (for example, «Your summary is ready», «Transcription completed», «The Bot could not join the meeting»);
- registration confirmations, email verification, and password resets;
- notifications of Account and session activity (sign-in from a new device, password changes, suspected unauthorized access);
- notifications of payment status, Subscription renewals and expirations, refunds, receipts, and other payment documents;
- notifications of changes to the Terms of Service, the Privacy Policy, the Cookie Policy, the Public Offer, and other legal documents;
- notifications of information-security incidents;
- replies to the User’s requests to technical support.
3.3. The User may refuse service messages only by deleting their Account and ceasing to use the Service.
4. Categories of data processed
4.1. For the purpose of sending marketing communications, the Operator processes the following User data:
- email address;
- name (if available);
- Account identifier;
- User preferences regarding mailing topics (where applicable);
- the fact and date of granting and/or revoking the Consent;
- engagement data (whether messages were opened, whether links were clicked) — used to measure effectiveness and improve relevance.
4.2. The Operator does not use data about the content of User Content (transcripts, summaries, notes) to target or select marketing messages.
5. Recipients and processors
5.1. For technical delivery of communications, the Operator may engage third-party email and push-notification delivery providers (hereinafter — «Mailing Services»). The list of Mailing Services used and the jurisdictions where they are hosted is set out in section 8 of the Privacy Policy.
5.2. Mailing Services process User data solely on behalf of the Operator and to the extent necessary for technical delivery, and may not use it for their own purposes.
6. Duration and revocation of Consent
6.1. This Consent is granted by the User for an indefinite term (until revocation) and may be revoked at any time.
6.2. Consent may be revoked in any of the following ways:
- through the «Unsubscribe» link included in every marketing message;
- by disabling the corresponding setting in the personal account («Settings» → «Notifications»);
- by sending a revocation notice to the Operator’s email address listed in the preamble.
6.3. The Operator shall stop sending marketing messages to the User within no more than 3 business days from receipt of the revocation. Within that window, the User may still receive previously scheduled messages.
6.4. Revocation of the Consent does not affect the lawfulness of marketing communications carried out before the revocation, nor does it affect the delivery of service (transactional) messages (section 3), and does not lead to deletion of the Account.
7. User rights
The User has the right to:
- know what data the Operator processes for marketing-communication purposes;
- revoke the Consent at any time in the manner set out in section 6;
- demand that the Operator cease processing their data for marketing purposes upon revocation of the Consent;
- appeal the Operator’s actions or omissions to Roskomnadzor, the Federal Antimonopoly Service (FAS), or through judicial proceedings.
8. Operator’s liability
8.1. The Operator undertakes to send marketing messages only to Users who have granted this Consent and to discontinue them upon revocation within the prescribed period.
8.2. The Operator is not liable for the actual delivery of messages in cases of:
- an email address incorrectly entered by the User;
- messages being blocked by the User’s mail service or provider;
- technical failures on the side of Mailing Services or other third parties.
9. Changes to this Consent
9.1. The Operator may amend the terms of this Consent. The current version is published on the Site.
9.2. For material changes that expand the scope or purposes of marketing communications, the Operator notifies the User by email and, where necessary, requests fresh Consent.
10. Contact information
For questions related to marketing communications and the exercise of the rights described in this Consent, as well as for any personal-data questions, the User may contact the Operator at support@resalt.app.
